Alec Baldwin is set to be charged with involuntary manslaughter for the shooting on the set of Rust, which resulted in the death of Halyna Hutch.

Actor Alec Baldwin is set to be charged for the incident that took place in October 2021 on the set of Rust, which resulted in the death of cinematographer Halyna Hutch.

According to the Wall Street Journal, Baldwin is set to be charged with involuntary manslaughter for the shooting of Hutch, along with Rust‘s armorer Hannah Gutierrez Reed, who has pleaded guilty. First assistant director David Halls has also pled guilty to the charge of the negligent use of a deadly weapon. The charges will be filed by the end of the month.

In New Mexico, involuntary manslaughter is a fourth-degree felony that carries a maximum sentence of 18 months imprisonment. Baldwin’s team has not provided comment. However, the actor has previously denied pulling the trigger on the gun. “I would never point a gun at anyone and pull the trigger at them, never… Someone put a live bullet in a gun, a bullet that wasn’t even supposed to be on the property.”

Initial reports suggested Hutch died from her injuries after being shot with a bullet fired from a prop gun by Alec Baldwin. According to the sheriff’s department, Hutchins was rushed to the University of New Mexico Hospital by helicopter where she was pronounced dead. While an investigation was launched, it remains unclear how live ammunition made its way onto the film set.

It is known that Halls and Gutierrez Reed handled the weapon before it made its way into Baldwin’s hands. The actor was, at the time, practicing drawing the revolver. Following the incident, Baldwin filed a lawsuit against Halls and Gutierrez Reed, claiming they showed negligence in their duties by handing the actor a loaded gun. In response, Gutierrez Reed’s team argued, “[Baldwin] is the only one responsible for this tragedy.”

Reports also suggested Rust faced several behind-the-scenes issues, including a major walk-out just hours before the shooting took place, brought on after camera operators and their assistants reportedly raised the issue of their long work hours, paycheck delays and, finally, issues concerning their lodging. On the day of the shooting, the union crew members were asked to leave and the film’s producers replaced them with non-union members. Those familiar with the matter previously explained there were corners being cut and “there was a serious lack of safety meetings on this set.” In fact, there had been three prop gun misfires in the week leading up to the shooting.
